Application of Real Property Registration



・purchase and sale

Foreign nationality can also purchase sorts of properties located in Japan such as real estate, car and so on.
To purchase ordinal property in Japan, you usually need to get neither special approval nor permission only due to foreign nationality.
You would get the properties and necessary documents for transferring the land title. Then, you give documents for transferring the land title to solicitor you hire for it.


・inheritance

Inheritance shall commence upon thedeath of thedecedent.If your relatives died , you need to think that transfer property title.If you own real properties in Japan, the heir(including foreign national residing abroad) of such properties must follow Japanese inheritance procedures .

Will

Inheritance procedures for foreign nationals who reside in Japan are complicated as well. It is advisable to prepare in advance such as making a local will.

There are 3 types of Ordinary Will .

Will by Holograph Document
To make a will by holograph document the testator must write the entire text, / the date, and his/her name in his/her own hand and affix his/her seal
To make a will by holograph document the testator must write the entire text.
and, all must be written in the testator own hand and the document of the will must be affixed the own seal.

Will by Notarized Document
Documents made by notaries are really stable and it is difficult to make them void. But,This type of will can be made only in Japanese language. Therefore, if a testator cannot speak Japanese, a interpriter should go to the notary office with the testator and the translation should be made for the testator.

Will by Sealed and Notarized Document
 A will by sealed and notarized document shall be made in compliance with the folliowing formalities.

(i)  the testator shallsign, and affix his/her seal to, thecertificate.
(ii)  the testator shall seal the certificate registration certificate and , using the same stamp as that use thecertificate, affix his/her seal.
(iii)  the testator shall submit the sealed certificate before one notary publicand and not less than two witnesses, with a statement to the effect that it is his/her own will, giving the author's name and address.
(iv) after having entered the date of submission of the certificate and the statement of thetestator upon the sealed document a notarypublic shall , together with thetestator and witnesses, sign it and affix his/her seal.
